Prosecutors in Florida have decided not to use alcohol breath-test results in about 100 current driving under the influence (DUI) cases in Sarasota and Manatee counties after learning about problematic breath-test machines.
The announcement came after the Herald Tribune reported that drivers across Florida have been arrested and convicted of DUI charges based on flawed breath-test machines that reported impossible results.
The State Attorney’s Office said it reviewed DUI cases and will send letters notifying defendants who were tested on five Intoxilyzer 8000s that the machines were not working properly and therefore the breath-test results will not be used as evidence against them.
Prosecutors will still pursue DUI charges in those cases where there is other evidence the driver was impaired.
