Aflac is very protective of its popular spokesduck; so when Ohio gubernatorial candidate Tim Hagan started using a similar image of the feathered friend on his Web site to attack incumbent governor Bob Taft, the insurance company sought a temporary restraining order and a permanent injunction to block the ads.
However, U.S. District Court Judge Kathleen O’Malley refused to grant the TRO, ruling that Hagan’s quacker was protected by his First Amendment rights to free speech. A hearing on the injunction request is scheduled for October 10.
