Trump May Ask Supreme Court to Reconsider Carroll Appeal Denial

President Donald Trump may ask the US Supreme Court to reconsider its decision to turn away his appeal of a $5 million verdict against him in E. Jean Carroll’s sexual-abuse lawsuit, her lawyer said in a court filing asking for an immediate payout of the damages award.

Lawyers for the former Elle magazine writer asked a federal judge in Manhattan on Tuesday night to release $5.55 million Trump handed over to the court in 2023 as a guarantee of the award, plus interest while he appealed, saying “it is time for this case to end.” With the additional interest, the total payout Kaplan’s attorneys now seek is $5.77 million.

Carroll’s lawyer Roberta Kaplan said it’s just the latest attempt by Trump to delay the case after a jury found him liable more than three years ago.

“This time around, he remarkably seeks to further delay Carroll’s collection of the judgment awarded to her in 2023 by stating that he is considering whether to move for reconsideration of the Supreme Court’s denial of his petition,” Kaplan said in the filing. “But this is the end of the line.”

A federal jury in Manhattan found Trump liable in May 2023. The federal appeals court in Manhattan upheld the verdict. The Supreme Court declined Monday to hear Trump’s appeal, in a decision that didn’t give an explanation and was not signed.

Carroll accused Trump in the civil suit of assaulting her in a Bergdorf Goodman department store dressing room in 1996, and then defaming her in 2022 by calling her a liar and saying she was not his “type.”

Trump has indicated he also will seek Supreme Court review of a separate $83.3 million jury award in a separate defamation suit Carroll filed. The president has also posted a financial bond in that case while he appeals.

Trump had argued that jurors in the sex-abuse case shouldn’t have been allowed to hear testimony about two prior alleged sexual assaults or listen to the Access Hollywood tape in which he boasted in vulgar terms that he could grab women by their genitalia without consent.

Kaplan declined to comment. In her filing, the lawyer said Trump’s attorney asked her to hold off seeking to enforce the judgment while the president considers asking the Supreme Court to reconsider. She said she rejected the request.

A representative for Trump’s legal team said the case is a “hoax” and that the president “continues to focus on his mission to make America great again.”

In her filing, Kaplan cited Trump’s social media post about the Supreme Court turning away his appeal, in which he repeated many of his attacks on Carroll. She said Trump “yet again continued his stream of defamatory attacks.”
