An Amtrak employee who was on the train that derailed Tuesday in Philadelphia accused the railroad company of negligence and seeks more than $150,000 in damages.
Bruce Phillips suffered a traumatic brain injury and multiple contusions and lacerations in the accident, according to a complaint he and his wife filed Thursday in federal court in Philadelphia.
Phillips “was violently hurled about the railcar, striking his body on numerous parts of the railcar interior, before slamming onto the floor,” according to a copy of the complaint posted on the website of the NBC affiliate in Philadelphia. The filing couldn’t be confirmed immediately in electronic court records.
Representatives of Amtrak in New York didn’t immediately respond to an e-mail after regular business hours seeking comment on the lawsuit.
The case is Phillips v. National Railroad Passenger Corporation (Amtrak), 15-2694, U.S. District Court, Eastern District of Pennsylvania (Philadelphia).
