A Canadian trucking company suing the state of New Hampshire over winter road conditions that led to the Interstate 93 traffic death of a 6-year-old boy says the state is withholding police accident reports in an attempt to stymie the company’s claim.
The company, Fidele Tremblay of Sainte-Luce, Quebec, alleges the Transportation Department failed to clear ice and snow off I-93 in February 2007. Brendon Mahoney was killed when his mother’s van was hit by a tractor-trailer that jackknifed on the slippery road. His mother won a $2.5 million settlement from Fidele Tremblay.
The New Hampshire Union Leader reports in a court filing, Assistant Attorney General Lynmarie Cusack wrote the police reports on other accidents aren’t relevant to the case.
